Greetings to our readers!

 

      The LSPU-SCC third year JD students AY 2015-2016 of the Special Proceedings class under Hon.  Judge Divinagracia Bustos-Ongkeko prepared this blog initially as a class requirement to pass the subject but hopefully, this would also be of help to other law students, those in the law profession or even ordinary people who may be interested in the knowledge of the law.

 

     This blog is about Special Proceedings which cover rules 72-109 of the Rules of Court. Justice Herrera defines “special proceeding” as, “an application or proceeding to establish the status or right of a party, or a particular fact”. Section 1 of Rule 72 enumerates the cases covered by special proceedings but the cases are not limited to the ones enumerated in the said section.

 

     It differs from an ordinary “action” wherein the bone of contention is the demand for one’s right in a manner prescribed by law. It is also noteworthy that in special proceedings, formal pleadings are not required unless the law specifically provides for it. Instead, remedies are granted through motions or applications.

 

     As you will discover, the proceedings covered are familiar ones which probably anyone can relate to. The contents of this blog were created using layman’s terms, if possible, and the purpose is to simplify the wordings of the law in such a way that may be easily understood by common people who do not have basic knowledge of the law. In a way, we are trying to make knowledge of the law accessible to more people – considering the fact that people of today, young and not-so-young are getting more and more technologically-savvy – creating this blog is our own little way of giving back to the community.
